By submitting an entry, you agree to all these General Contest Rules. Each specific contest may have additional rules.

1. NO PURCHASE OR PREMIUM MEMBERSHIP NECESSARY. Making a purchase or signing up for a premium membership will not increase your chances of winning.
2. Swingers Couple members, standard or premium, in good standing as of date of entry and award of prize, may participate in any contest. Must be a legal US resident 18 years of age or older. Employees (and their immediate family members), agents and contractors, e.g., affiliates, advertising vendors, of Swingers Couple ("Sponsor"), Various, Inc., its subsidiaries, its parent company, FriendFinder Networks Inc., and its affiliated entities (hereinafter "Various") are not eligible to participate.
3. Entries must be made as required in the contest's announcement, e.g., blog, email, message center.
4. Your participation in any contest remains subject to Swingers Couple Terms of Use and Privacy Policy.
5. All entries must be uploaded to the site by the contest deadline, which will be stated in the specific contest. Swingers Couple is not responsible for entries that it does not receive for any reason, including technical malfunctions.
6. By entering any contest, you represent and warrant that you own (or have licensed) all intellectual property rights associated with the entry. As an example, if you enter a video contest, you may not include copyrighted or commercial content. All contests that require the submission of materials, such as photos, videos, or text, are subject to the following additional restrictions:
   • It must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity, or intellectual property rights;
   • It must not contain brand names or trademarks, other than (i) those of the Sponsor, which you have a limited license to use for the sole purpose of creating and uploading your submission, and/or (ii) those that you own, which you agree to license to Sponsor on a royalty-free, irrevocable, perpetual, non-exclusive basis, or have license to use and sub-license to Sponsor a royalty-free, irrevocable, perpetual, non-exclusive basis in connection with the submission;
   • It must not contain footage, music, images, artwork, literary, or other copyrighted material not created by you, other than material that you have necessary rights, consents and permissions to use and sub-license to Sponsor a royalty-free, irrevocable, perpetual, non-exclusive basis in connection with the submission;
   • It must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous, or libelous, as determined by Sponsor in its sole discretion;
   • It must not disparage Sponsor, or any party affiliated with the promotion and administration of contest;
   • It must not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and
   • It must not contain material that is unlawful, in violation of, or contrary to the laws or regulations in any jurisdiction where submission is created.
   • You must have permission from all individuals that appear in the submission (if any) to use their name, likeness, voice, and/or persona in the submission.
7. If requested by the Sponsor, you must be able to provide all required rights granted, consents, and permissions in a form acceptable to the Company.
8. All contest entries become the physical property of Sponsor. We do not return content. In addition, by entering, you grant to Sponsor a royalty-free, irrevocable, perpetual, non-exclusive sub-licensable license to use, reproduce, modify, publish, create derivative works from, and display your submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media, or technology now known or later developed for any legal use including without limitation, for promotional and marketing of Sponsor, and its products and/or services.
9. Only one prize will be awarded per person, couple, or household. If a member receives a prize, he, she, or they are not eligible to win another prize for 30 days unless otherwise noted in the specific contest. Prizes cannot be split between multiple participants or transferred to another person. Prizes are not redeemable for cash and all taxes, if any, on prizes are the sole responsibility of winners. Winners may be required to sign affidavits of eligibility and provide proof thereof within five (5) days of receipt of documents. In case eligibility cannot be verified, the affidavit of eligibility is not returned on time, or the winner cannot be contacted within a reasonable time, the prize will be awarded to the next runner-up. All federal state and local laws apply. Void where prohibited.
10. Members who win membership upgrades may substitute another premium site feature, e.g. Standard Contacts, Highlights, Private Chatrooms. The feature duration will be equal to that of the original prize won. No other substitutions are allowed.
11. Unless otherwise noted in the specific contest's rules, winners will be determined at the sole discretion of Sponsor and all results are final and binding. Winners will be notified by email or other appropriate method and agree to allow Swingers Couple to announce the results on Swingers Couple's public forums and/or email announcements. Sponsor also reserves the right to publicize the name of the winner and the winner's entry. The winner may be required to sign a release (of publicity rights) in order to claim the prize. If a release is required, the specific contest's rules will indicate.
12. Sponsor reserves the right to change rules and prizes without notification.
13. We do not require you to submit nude or otherwise sexually explicit photos or videos in order to participate in a contest.
14. By entering any contest, all entrants agree to release and forever discharge Various, its advertising, promotion, and advertising agencies and their respective parent, affiliate, and subsidiary entities and the respective employees, directors, and officer of the foregoing entities from any and all costs, fines, claims, injuries, losses, damages, or liabilities of any nature whatsoever to persons or property, which they may now or hereafter assert, including but not limited to, claims based on publicity rights, defamation, invasion of privacy, injury, death, illness, or damages resulting in whole or in part, directly or indirectly, from acceptance, receipt, ownership, possession, misuse, or use of the prize or from participation in the contest or in any contest or prize related activity; and entrants specifically waive all rights to claim punitive, incidental, indirect, and consequential damages, attorneys' fees or any damages other than actual out-of-pocked costs incurred to enter. Entrants further agree to waive any right to claim ambiguity in these General Contest Rules.
15. Sponsor assumes no responsibility for: lost, late, damaged, incomplete, stolen, misdirected, illegible, unreadable, or returned entries; any computer, telephone, cable, satellite, network, electronic, or Internet, hardware or software malfunctions or failures; garbled, corrupt, or jumbled transmissions; service provider/Internet/web site inaccessibility or unavailability, traffic congestion, or technical failures; unauthorized human intervention; incorrect or inaccurate capture of entry or other information or the failure to capture such information, whether caused by entrants, equipment, or programming associated with or utilized in any contest or by any technical or human error; and/or other errors of any kind. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor is not responsible for lost, interrupted, or unavailable network server or other connections, miscommunications, failed telephone or computer, or telephone transmissions or technical failure, jumbled, scrambled, or misdirected transmissions, or other error of any kind whether human, mechanical, or electronic. Persons found tampering with or abusing any aspect of a contest or the operation of any website, will be disqualified and ineligible to participate.
16. In the event any portion of any contest is compromised by virus, bugs, non-authorized human intervention, or other causes beyond the control of Sponsor, which in its sole opinion, corrupts or impairs the administration, security, fairness, or proper play of the contest, Sponsor reserves the right, in its sole discretion, to suspend, terminate, or modify the contest. In no event will more prizes be awarded than those listed on the applicable contest page.
17. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligation of the entrants and Sponsor in connection with any contest, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules.
18. To obtain a copy of the winner list, for any contest send a stamped, self-addressed (#10) envelope your request to: [SPECIFY NAME OF CONTEST] Winners List, C/O Various, Inc., 1615 S. Congress Avenue, Suite 103 Delray Beach, Florida 33445. Requests must be received no later than two weeks following the end date for entries of the applicable contest.
